Pickkk Terms of Service

These terms set out the rights and obligations between you and andnextlab (앤넥스트랩, "we") when you use Pickkk ("the app"). How we handle personal information is described separately in the Privacy Policy.

This is a translation of the Korean terms. If the two differ, the Korean version prevails. Nothing in these terms limits rights you have under mandatory consumer laws of the country where you live.

1. The service

• The app picks one or more people at random from the people in a photo.
• The app is free and supported by ads (section 6). Pickkk Plus (section 7) is a paid feature that removes ads.
• There is no sign-up or login. By installing and using the app, you agree to these terms.
• The app is intended for adults aged 18 and over.

2. Publishing and changing these terms

• We make these terms available on the "About" screen of the app and on this web page.
• When we change the terms, we announce the new version, what changed and when it takes effect at least 7 days in advance, or at least 30 days in advance if the change is unfavorable to you. Earlier versions remain available in the history below.
• If you do not agree to the changed terms, you can stop using the app and delete it. If you keep using the app after the effective date, you are treated as having agreed to the changed terms.

3. Photos and portrait rights

• Photos and face information are processed only on your device and are never sent to us.
• Use only photos you have the right to use. You are responsible for the portrait rights and privacy of other people in the photos you choose and in the results you save or share. Please ask the people in the photo before saving or sharing a result.

4. Pick results

• Picks are random. A condition such as "the biggest smile" may be set for a pick; it only raises the chances, and anyone can still be picked.
• Depending on the photo, face detection may miss people or mistake something else for a face.
• Pick results are for fun and convenience. You decide how to use them, and any decision based on a result, and any dispute over it, is between you and the participants.

5. Prohibited conduct

You must not:

• use photos or results in a way that infringes other people's portrait rights, privacy or reputation
• reverse engineer or tamper with the app, or modify it to bypass payments or ads
• interfere with ads by improper means, such as deliberately tapping ads repeatedly
• disrupt the normal operation of the app or the Pickkk server

6. Ads

• The app shows Google AdMob ads. A full-screen ad may appear in the middle of the pick animation once every two picks.
• Advertisers are responsible for their ads and for the products and services the ads link to; we do not endorse them.
• The information used for ads and how to opt out of personalized ads are described in section 4-5 of the Privacy Policy.

7. Pickkk Plus

• What you get: buy it once and the app no longer shows ads. It has no time limit and does not renew or charge you again.
• What is not included: other paid features we may offer separately in the future (for example, server-based AI features or subscriptions).
• Price: the price shown by the store on the purchase screen. Taxes and currency may vary by store and country.
• Payment: you pay through Google Play on Android or the App Store on iOS. Payment methods and receipts are governed by each store's terms and policies.
• Scope: Pickkk Plus is tied to the store account you paid with (Google account or Apple Account). You can use it on other devices signed in to the same store account, but it cannot be moved between Android and iOS.
• Restoring: after reinstalling the app or changing devices, use "About → Restore purchase" to get it back. The app also checks automatically when it starts.

8. Cancellations and refunds

• Pickkk Plus is digital content that removes ads as soon as payment is complete. Once it has been provided, you may not be able to cancel simply because you changed your mind (Korean Act on the Consumer Protection in Electronic Commerce, Article 17(2)5).
• However, if ads keep appearing after you paid and restoring or contacting us does not fix it, or if Pickkk Plus is not provided as described in these terms or on the purchase screen, you can cancel within 3 months of receiving it, or within 30 days of when you learned or could have learned of the problem (the same Act, Article 17(3)).
• If a minor paid without the consent of a legal guardian, the minor or the guardian can cancel the payment.
• How to get a refund: the store processes the payment, so refunds also go through the store.
  • Google Play: within 48 hours of purchase, you can request a refund directly on Google Play. After that, email us and we will review it and refund through Google Play.
  • App Store: Apple processes refunds, and we cannot refund directly. Please request one at reportaproblem.apple.com. Email us if you need help.
• When a purchase is refunded, Pickkk Plus is removed and ads may appear again.

9. Changes to and suspension of the service

• To improve the app, we may change its features, screens, and where and how often ads appear. We will not, however, change it so that users who bought Pickkk Plus see ads again.
• If we must end the service, we will announce it in the app or on this web page at least 30 days in advance, and handle paid features in accordance with applicable law and store policies.
• The service may be temporarily unavailable for reasons beyond our control, such as device failures, store or network outages, or natural disasters.

10. Limitation of liability

• To the extent permitted by law, we do not guarantee that the free features of the app work accurately on every photo.
• We are not responsible for disputes arising from photos or results you save or share, or for losses caused by your breach of these terms.
• However, we remain responsible for losses caused by our intent or gross negligence, regardless of these terms.

11. Governing law and disputes

• These terms are governed by the laws of the Republic of Korea. If a dispute arises, please let us know at the email below first, and we will work in good faith to resolve it.
• Lawsuits that cannot be resolved this way are handled by the court with jurisdiction under the Korean Civil Procedure Act, without prejudice to any right you have to bring proceedings in the courts of your country of residence.
• If you got the app from the App Store, Apple's Standard End User License Agreement (EULA) also applies; where the two differ, these terms prevail. Apple is not responsible for the app or these terms.
